Avery Substitute Judge Request Denied

Steven Avery’s request for a substitute judge is being denied. A Sheboygan County judge made the ruling Monday, calling his request “premature”. The ruling adds that the US Court of Appeals still has jurisdiction over his appeal, and the lower courts have “limited jurisdiction to consider new evidence” in his trial. Avery’s attorneys have until Saturday to submit a brief with the previously undisclosed evidence, and a ruling should be issued within sixty days. The court has not been ordered to hold an evidentiary hearing on the matter yet – according to the ruling judge. Avery continues serving a life sentence in the 2005 death of Teresa Halbach.
