Placement Of Sex Offender On Nitschke Road Temporarily Blocked


A Marinette County judge has temporarily stayed his order to have a violent sex offender placed at a residence in Fond du Lac County’s Town of Eldorado. Judge James Morrison didn’t have an opportunity to sign that order until Friday. The state’s Department of Health Services wouldn’t recognize the order until he signed it and decided to try and place 54-year-old Jeffrey Butler at the residence on Nitschke Road at 6 a.m. Friday morning. Fond du Lac County Sheriff Mick Fink says they got word of that and had a County judge issue a temporary restraining order against the placement. Deputies took turns standing guard on the road waiting to serve whoever showed up from DHS with the restraining order. Fink says he took a turn himself Friday morning waiting for DHS. He says, “I got up at 4:15 this morning and I said we will stand on this road and we will enforce this restraining order.” Fink says Judge Morrison decided to stay his order for placement until he could hear the Town of Eldorado’s arguments against Butler’s placement, but DHS knew if they got Butler in there first it would be hard to have him removed. He says, “It’s a lot of games and it’s a lot of people you know playing with the law and playing fast and loose with it and it is really frustrating for somebody on my end to look at the people on the road out there on Nitschke Road in the Town of Eldorado and try to have to explain that to them.” They learned Friday morning from probation and parole that DHS had backed off on the placement.
