Rubicon Man Sentenced to 10 Years in Prison

A 54-year-old man from the Town of Rubicon in Dodge County has
been sentenced to 10 years in prison, followed by three years of probation
after being convicted for his fifth OWI and charges of Felony Intimidation of a
Victim and Felony Bail Jumping.


Earl Captain was arrested in October of 2018 after police
were called to his home when a woman reported he was drunk, had hit her,
pointed a gun at her and destroyed many belongings in the home. The woman said
Captain threatened to kill her if she called police. Captain was ultimately arrested
and put in jail on a $2,500 cash bond after the state had asked for a bond of 25-thousand
dollars. Captain posted bond and was released.


A news release says Captain was not allowed to drink, have
a gun or have contact with the victim – but went to the victim’s home drunk and
armed with a gun less than two months after posting bond the first time. He was
arrested again and this time was placed on a bond of $10,000, which he posted. A
few months later – Captain was arrested for his fifth OWI near the intersection
of Schuyler Street and Pond Road after another driver reported he was swerving
into oncoming traffic. Following this incident, the court granted the State’s
request for a $100,000 cash bond, and Captain has been in jail ever since.
