SCOWIS Says You Can Be Arrested In Your Driveway
The State Supreme Court says police can arrest you for drunk driving if you’re parked in your own driveway.
In a 6-1 ruling, the State Supreme Court says a judge did not make a mistake in issuing a warrant for a blood draw for Valiant Green after police arrested him for probable OWI in 2019.
The request for a warrant was a preprinted form, and Green’s attorney tried to argue that police had no cause to search Green because they couldn’t assume that Green drove on a public road. The Supreme Court disagreed.
Green was charged with 4th time OWI and resisting arrest.
