State Responds to Avery Evidence Claims

The State of Wisconsin is responding to Steven Avery’s claim that he didn’t get a fair trial – based on the discovery of a CD that was not presented at trial. Avery continues to appeal his conviction, as his attorney Kathleen Zellner filed a motion claiming that failure to disclose the CD of evidence violated his rights. 

She says the CD contains thousands of images of sexual violence against young women. The evidence was pulled from a computer in Brendan Dassey’s home – but Zellner believes it was used primarily by someone else in the home, and that person could have been established as a third-party suspect in the death of Teresa Halbach. 

The state says there was no previously undisclosed material on the disc that wasn’t on the DVDs obtained by the trial attorneys.
