Toney Calls Attempt To Remove Prehn “Frivolous”

Fond Du Lac District Attorney Eric Toney, issued the following statement regarding current Wisconsin Attorney Josh Kaul’s loss, in Wednesday’s Supreme Court ruling.

“One year after I called on Josh Kaul to dismiss his frivolous attempt to remove Dr. Prehn from the DNR Board, the Wisconsin Supreme Court agreed saying Kaul was wrong on the law and dismissed Kaul’s lawsuit. This is what happens when you elect someone who uses the office of Attorney General to play political games to appease his leftist allies.” 

Kaul and Toney are locked in the state-wide battle for Attorney General in the upcoming fall election.

Toney continued by saying, “Wisconsinites deserve an Attorney General who knows the law and will follow the law, regardless of the politics of the day. As I said last year when Josh Kaul filed suit: “The rule of law is what we have to abide by and the rule of law isn’t always popular. The problem that we have is our Attorney General is continuing to play politics with the office.””   

“When I am elected Attorney General Wisconsinites can count on me to not look at my job as a daily political stunt on the taxpayer’s dime. I am grateful that the Wisconsin Supreme Court saw through the antics and ruled based on the letter of the law.” 

Prehn has remained on the DNR Board, even though his term expire nearly a year ago. Republicans have yet to approve Governor Tony Evers’ appointment for the position.
