Trial Delayed And Hearing Time Limits Waived In Drug Overdose Cases
Fond du Lac County Judge Peter Grimm this week granted a motion to delay a jury trial for a 34-year-old Milwaukee man suspected of injuring a jailer who was trying to get a DNA sample from him. District Attorney Eric Toney asked for the delay because the case is related to another involving Roy Whitelow. Whitelow last Friday was charged with 1st degree reckless homicide and heroin trafficking in connection with the heroin overdose death of 27-year-old Heather Fugate of Fond du Lac this past February. He’s accused of supplying her with the heroin that led to her death. Part of the evidence in the drug overdose case was DNA found on a baggie of heroin at Fugate’s home following her death. The trial had been set for two days. Meanwhile Whitelow was supposed to have a preliminary hearing Thursday in the drug overdose case, but waived the time limits for the hearing.
